Terms of Service

1. The service
FLEETBAQ is business software for trucking fleets: dispatch, load tracking, driver GPS during active loads, document scanning, driver messages, accident and breakdown reports, payroll statements, and IFTA mileage tools. By creating an account or using the app you agree to these terms.
2. Accounts
You are responsible for your login credentials and for activity under your account. Fleet owners are responsible for the drivers they invite. You must be 18 or older and use FLEETBAQ only for lawful business purposes.
3. Your data
Your fleet data belongs to you. We store and process it only to run the service, as described in our Privacy Policy. You are responsible for the accuracy of data you enter.
4. Driver location
Driver GPS sharing requires the driver's consent in the app and operates only while a load is active, as described in the Privacy Policy.
5. Accident and breakdown reports
Report a problem in the driver app sends the driver's report (answers, photos and, during an active load, the phone's position) to the driver's own carrier only. It does not contact police, ambulance, towing or any emergency service. In an emergency, call 911 first. The DOT accident checklist, the accident register and post-accident testing reminders in FLEETBAQ are tools to help the carrier; the carrier remains responsible for deciding what is recordable and for meeting its FMCSA obligations (49 CFR 390.15, 382.303).
6. Text messages (SMS)
Fleets: when you invite a driver by text, FLEETBAQ sends one text to the mobile number you enter, with the invite code and a sign-up link. Enter only the number of a driver who gave it to you and agreed to get this text, and tick the consent box to confirm it; FLEETBAQ records who ticked it and when. Do not use invite texts for anything else.
Drivers: the invite text is transactional. We do not send marketing or promotional texts. Consent to texts is not a condition of using FLEETBAQ or joining a fleet: the code can also be given to you in person or by email and typed in the app.
- Message frequency: one text per invite; a fleet can resend it, up to 3 texts to a number per day.
- Message and data rates may apply.
- Reply STOP to unsubscribe at any time; reply START to receive texts again. Reply HELP for help, or email contact@fleetbaq.com.
- Mobile carriers are not liable for delayed or undelivered messages.
- Mobile numbers and SMS opt-in data are never sold or shared with third parties for marketing or promotional purposes — see the Privacy Policy.

7. Not professional advice
Payroll estimates, tax withholding estimates, IFTA figures, DOT accident checklists, and financial reports are tools, not tax, legal, or accounting advice. Verify filings and withholdings with your accountant or payroll provider. You remain responsible for regulatory compliance (FMCSA, IFTA, IRS, state agencies).
8. Third-party services
ELD/GPS provider connections use credentials you supply and are subject to those providers' own terms. We are not responsible for third-party outages or data errors.
9. Availability & warranty
The service is provided "as is" and "as available," without warranties of any kind. We do not guarantee uninterrupted or error-free operation.
10. Limitation of liability
To the maximum extent permitted by law, FLEETBAQ's total liability for any claim is limited to the amounts you paid for the service in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits, lost loads, or missed deliveries.
11. Termination
You may stop using the service at any time. We may suspend or terminate accounts that violate these terms or abuse the service. On request we will delete your account data.
12. Changes
We may update these terms; the current version is always at fleetbaq.com/terms.html. Continued use after changes means acceptance.
